Terms and Conditions

1. Scope

1.1 These Terms and Conditions (T&Cs) govern the use of the web-based platform "Pokepreis" (hereinafter the "Platform"), which is provided by the operator of Pokepreis (hereinafter the "Provider").

1.2 The T&Cs apply to all users of the Platform, regardless of whether they merely use the Platform for informational purposes or create a user account.

1.3 Deviating, conflicting or supplementary terms of the user shall not apply unless their validity has been expressly agreed in writing.

2. Description of services

2.1 Pokepreis is a digital platform for displaying, managing and analysing trading cards, in particular Pokémon trading cards.

2.2 The Platform offers, among others, the following features:

• Display of trading cards and card-specific information
• Provision of price and value indications
• Creation and management of digital collections
• Digital recording of physical cards for personal management
• Image recognition feature for identifying cards via camera or image upload

2.3 Price information provided is intended exclusively as non-binding guidance and does not constitute binding market prices, nor any buy or sell recommendations.

2.4 The Provider reserves the right to expand, restrict or adjust the scope of features of the Platform at any time, provided this is reasonable for users.

3. Registration and user account

3.1 The use of purely informational content is generally possible without registration.

3.2 Registration of a user account is required to create and manage a digital collection.

3.3 The data requested during registration must be provided completely and truthfully.

3.4 Users are obliged to keep their access credentials confidential and to protect them from access by third parties.

3.5 The user account is non-transferable.

4. Premium access

4.1 The Provider may offer paid premium features, in particular the option to create multiple collections or extended analysis features.

4.2 The scope, term, prices and cancellation conditions of premium access are presented separately and form part of the respective contract.

4.3 Unless expressly stated otherwise, premium access does not renew automatically.

5. Marketplace and sale of products

5.1 At a later point in time, the sale of physical products such as card cases or accessories may be offered via the Platform.

5.2 Supplementary terms of sale apply to purchase contracts for such products and will be made available to the user separately before conclusion of the contract.

6. Image recognition feature

6.1 The Platform provides an image recognition feature that allows users to photograph or upload trading cards.

6.2 Recognition results serve solely as support and may be incorrect. No warranty is given for the accuracy of the recognition.

6.3 Users warrant that they are entitled to use the uploaded images and that no third-party rights are infringed thereby.

6.4 The image recognition AI is used to automatically identify trading cards. Recognition may be incorrect. Users are obliged to verify the results themselves.

6.5 Users may only upload images for which they hold the necessary usage rights.

6.6 The Provider assumes no liability for misidentifications or for any decisions resulting from them.

7. Usage rights and content

7.1 Users grant the Provider the simple, geographically unrestricted right to process the content uploaded by them for the operation of the Platform.

7.2 The grant of rights ends with the deletion of the respective content or of the user account, unless statutory retention obligations exist.

7.3 Users must not use the Platform abusively, in particular must not post any unlawful, offensive or misleading content.

8. Availability of the Platform

8.1 The Provider strives for the most uninterrupted availability of the Platform possible but does not warrant continuous availability.

8.2 Maintenance, further development or technical disruptions may lead to temporary restrictions.

8.3 The price and market data displayed on Pokepreis is in part sourced from external data sources and third-party interfaces. The Provider gives no warranty as to the availability, currency, accuracy or completeness of this data. Technical failures, delays or deviations may occur at any time. Price information does not constitute binding market prices, valuations or recommendations to buy or sell trading cards.

9. Liability

9.1 The Provider is liable without limitation for intent and gross negligence.

9.2 In the case of slight negligence, the Provider is liable only for breaches of essential contractual obligations and limited to foreseeable damages.

9.3 The Provider assumes no liability for the accuracy, currency or completeness of price or value information.

9.4 Liability for lost profits is excluded to the extent permitted by law.

10. Affiliate links / partner programs

10.1 The Platform contains affiliate links, in particular to the eBay Partner Network. Via these links, the user is directed to offers from third parties (e.g. eBay).

10.2 If a purchase is made via such a link, the Provider may receive a commission. This does not result in any additional costs for the user.

10.3 The purchase contract is concluded exclusively between the user and the respective third-party provider. The Provider is not a party to the contract and assumes no warranty for offers, prices, availability, or processing by the third-party provider.

11. Data protection

11.1 Personal data is processed in accordance with applicable data protection laws.

11.2 Details are set out in the privacy policy, which forms an integral part of the use of the Platform.

12. Term and termination

12.1 Users may delete their user account at any time without notice.

12.2 The Provider reserves the right to suspend or delete user accounts that violate these T&Cs.

13. Changes to the T&Cs

13.1 The Provider is entitled to change these T&Cs where there are objective reasons to do so.

13.2 Registered users will be notified of changes in good time.

14. Final provisions

14.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

14.2 To the extent permitted by law, the place of jurisdiction is the registered office of the Provider.

14.3 Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions shall remain unaffected.
